Copyright:
The copyright of the photographs remains the property of the photographers. The client is not licensed to resell the photographs or to approve their use for publication by any other person, company or organisation INCLUDING FOR COMPETITIONS without the written agreement of the photographers.
Moral rights under the Copyright, Designs and Patents Act 1988 are asserted on all photographs referred to in this document.
The client shall not breach these regulations by means of downloading, copying in any manner, altering or duplicating without specific permission either provided proof images or full resolution purchased copies THIS INCLUDES USE OF SOCIAL MEDIA FILTERS, STICKERS OR SIMILAR APPS.
Digital images are sold with a certificate of RIGHTS TO PRINT copyright remains with the photographer as per UK law.
Use of Images:
The photographers confirm that they will not supply the photographs to any other person, company or organization without the permission of the client except as detailed for purposes below.
Signature agrees that the photographers (including & not limited to their students & associate photographers) may use the work in their corporate publicity in forms acceptable to the client including but not limited to portfolio, web design, news, adverts and displays both in house & off site.
Where commissioned images feature a person under 18 signature confirms you have responsibility as a parent or guardian and agree to the use of said images as previously outlined in correspondence and above.
Co-operation:
At all times the photographer's artistic licence will be deemed as correct based upon your consultation. Working with small children and babies can be unpredictable, no guarantees as to the number of images to be viewed are made & no specific poses are promised whether attempted during the session or otherwise.
Children are at all times the responsibility of their guardians & safety directions should be followed. Should direction be ignored CAM Photography reserves the right to terminate the session on the grounds of safety.
Should the photographer deem a re-shoot necessary a suitable appointment will be made at the discretion of CAM Photography, re-shoots will not be offered to due lack of co-operation from those aged five and over.
Use of Camera Phones:
Behind the scenes shots are permitted on camera phones only & we politely request they feature the working scene & not baby or child alone. We love to see your behind the scenes images with the hashtag #camphotographywigan & you can find us as victoriavarnamphotography on Instagram.
Investment:
After your session you will be invited to view your gallery & order your chosen images in the studio. Payment for products is due at point of order at the time of your gallery view appointment. Where an order is deferred images will be transferred to storage after 7 days & a storage & administration fee of £25 applied at point of order. If no order is placed within 30 days of the photoshoot the images will be deleted.
Where committing to an on going program me such as the "Watch Me Grow" package you acknowledge the expectation to attend a viewing appointment after each session to place your order. Orders may not be combined across multiple sessions.
If you would like to purchase extra images from your session with us you may do so but there is no obligation to. Extra images start at £50 and duplicate prints from £15. Due to fluctuations in supplier pricing, changes in suppliers or the introduction of new products prices are subject to change at any time. If you would like an up to date pricing list please contact the studio and we will be happy to provide you with one.
This document will be applied to all forward sessions without further notice unless terms change.
Cancellations
If you are unable to keep your reservation, please contact the studio in order to rearrange or cancel as soon as possible. We require at least 24 hours notice to rearrange your photographic/gallery viewing session should you need to. There are several ways you may do this - Phone 01942396228, if unavailable, leaving a message is also acceptable. Texting (07540296666), via our Facebook page or emailing info@victoriavarnamphotography.co.uk. You will receive notification that we have had your request to rearrange to a different day from a member of the team. To rearrange an appointment with less than 24 hours before your photoshoot an administration fee of £35 will be payable.
In the case of a failure to show for a pre booked photoshoot a fee of £35 will be charged to re-book your photoshoot. If you are on an ongoing package such as bump to baby or watch me grow the £35 fee will be applicable in order to book the next photoshoot of the package.
If you or your child has been poorly with diarrhoea or vomiting then your session needs to be cancelled. The studio had the same 48 hour policy as schools and nurseries for the wellbeing of staff and other clients.
Gift Vouchers can not be exchanged for cash, are not refundable and can not be transferred to other sessions that we offer.
CAKE-SMASH - We can provide the cake through our recommended supplier cakes start from £35.00 . Due to the nature of the session once the cake has been ordered you will be committed to the date booked and no changes can be made, If the session is to be rescheduled you will have to repurchase a a further cake at your expense. We can not guarantee ( as with any sessions ) baby will get involved with smashing the cake etc. We are totally led by your baby and will go with their pace, we can not commit to how many images will be supplied from these sessions and we will not reshoot the session free of charge if baby will not get involved due to the bespoke nature of a cake-smash photo-shoot.
BOOKING FEES - We take booking fees to secure all our sessions. This is the full cost of the shoot/package you have booked. Please note that this is non-refundable & your session can only be transferred to another date if we have been given the correct notice of 24 hours to change your appointment with us & you have received confirmation from a member of the team. Please note that no refunds will be given on any sessions booked if you simply change your mind.
Please be aware that we allocate up to 1 hour per photo-session and 1 hour for a showcase session from our diary; therefore appropriate measures must be taken if you require a change in appointment time or to reschedule your appointment. These measures are defined above. If no such action is taken, your complimentary print included in your session (valued at £50.00) will be voided. For watch me grow packages if a photoshoot is missed and appropriate notice is not given you will be required to pay £30 to rebook the photoshoot.
MODEL CALLS
For promotional purposes by CAM Photography, the usage of you or your child is conditional on never having worked with another photography company previously within 6 months at time of booking. This is applicable within a 100-mile radius of our studios, with the corresponding postcodes of WN4 9AX. To secure the time in our studio, a 50% booking fee will be required; this will be refundable on the completion of the appointment. If you do not attend your appointment, or cancel without 24 hours notice, the session will be void and the booking fee lost. Please note, if you are chosen to represent CAM Photography your images may be used on our website, social media and for any other promotional purposes. When attending a model booking you do have the option to purchase further prints at the time of your showcase , To Qualify for the promotional price payment will be paid in full upon booking and images will be released to you after the session . Payments not paid in full will revert to our standard prices should you wish to pay just the booking fee. For any images uploaded to social media sites, please feel free to tag yourself for memories and hit share . We may offer promotional rates on model call images these will be available for that day only upon the view , these promotional rates will not be available at any other time . Any booking fees paid to secure your model session will be refunded upon completion of the session. In the event that you do not uphold any part of the session or you do not attend the view without a confirmed cancellation CAM Photography reserves the right to keep any monies previously paid for the time booked out of our diary.
WATCH ME GROW SESSIONS (WMG) and BUMP TO BABY/
These sessions are paid in full at the time of booking. If you fail to attend, or cancel without notice, on any of the the sessions then the corresponding complimentary print from the session will be voided. The print can then be released at a charge of £30.00 and a booking fee will then apply to any further sessions. Any sessions that have been completed to the point of non-attendance will still be honoured, in terms of the included prints in the package. Please note if you decide not to complete the WMG or BUMP to BABY program you are only entitled to one image from each session that you have attended. You cannot have two or three complimentary images from the same session. Watch me grow packages are valid until your little one is 18 months old. All sessions must have been completed by this date. Any unused sessions are void and not entitled to a monetary refund or to be transferred to a sibling. BUMP to BABY packages are valid up to one month after your baby turns one unless and any sessions not used by this time will not be redeeemable or refundable.
PURCHASE OF DIGITAL IMAGES
When purchasing digital images please back up your digital images in more than one location to ensure that they are safe. Once delivered to you we no longer store your images. This means if you have not backed up your images and your storage option fails they may not be available for us to resend.
PAYMENT PLANS
Please note any money previously paid to us as part of a payment plan will not be refunded if you want to end/cancel the agreement early. You will not receive any images unless the full amount for the collection you ordered is paid for in full .
If you are on a payment plan your images will be edited but your products will only be ordered once your payment plan is complete. If you have allowed us to share your images to social media this will only happen once full payment has been received.
COPYRIGHT
All images captured by us are owned and copyright protected under the copyright & patents act of 1988 by CAM Photography. It is a criminal offence to screenshot, copy, scan or reproduce your images in any way without full written consent from CAM Photography. When purchasing the digital images , please do not apply filters or digitally manipulate the images in any way this is against copyright law Please do not apply Facebook or Instagram filters. Please note, it is normal practice for us as a company to use images we take for advertising purposes, promotions and social media, with the purpose of showcasing our work and to keep our media current. once your image is uploaded to Facebook you can tag and share your beautiful images ,can we kindly ask that you leave the image sat on our page for a minimum of 48 hours after this time please feel free to use has profile images etc . If you do not wish the images we take to be used for such purposes, please bring this to our attention during your showcase session or contact us prior to your session.
The usage of your own camera is not permitted during any session (apart from our own of course), we are dedicated to capturing perfect images for you & your family. Please respect our work and keep your phones in pockets. If caught using your phone or Camera in a session your photo-session will be terminated no prints will be released & any fees paid will be Non refundable.
ORDERS
Please allow up to 30 working days (Mon - Fri) to receive your images/wall art, this time is taken from the point of order + 1 day and after full payment. This time allows us to maintain our high standards of presentation & allows any external work to be completed (Bespoke framing etc). We do not print our images on site and work with an external printers, therefore we will not be held accountable for any delays as a result of external factors. You may even need to come back into the studio to final proof your bespoke item before we send it to print. We personally check each individual order before it leaves each studio to make sure it meets our standards. Please try to be patient during this time, we know how excited you will be to receive your images and we will contact you as soon as its ready for collection.
Please note that any images not purchased at the gallery view appointment will be deleted immediately following the appointment. Once your images are delivered in whichever medium you choose your images will no longer be stored as we are unable to store your images indefinitely. If you do do not view your gallery within a month of your photoshoot date and you have an image included in your session fee we will choose the image for you and delete the remainder of the gallery. If you are not able to place an order at the gallery view you can opt to pay a £50.00 holding fee to secure your images to choose at a later date. This amount can then be used against products purchased at a later date. This must be within 6 months of the original photoshoot date.
If you purchase digital images it is your responsibility to back up your images as we are unable to store indefinitely. If you fail to do so and need us to provide a replacement USB there will be an administration fee of £25 to retrieve your images from storage if we still have them and £15 charge for a replacement USB.
Due to the custom nature of photography no cancellations or refunds are possible once you leave the studio. You will be given the opportunity to final proof your order at the time of your view and before your payment is taken by us - you will then sign for your chosen products, which will be then worked on & sent to print.
If you need your images sooner, please speak with us and you can opt for our express service.
Images purchased at the time of a view with a deposit to order will be disposed of & money will be lost ,if the images are not collected within a 3 month period of us contacting you to arrange collection .
PRICING
Prices are subject to change at any time. Please make sure you ask for an up to date price guide upon booking if you do not have one. To be fair to all our customers our prices are non-negotiable. If you do not see something on the price guide you are looking for please do bring this to our attention.
RETOUCHING & EDITING
Retouching in line with our portfolio is included in the price you pay for your prints/digital images/products. If you require further editing for example headswaps there may be an additional fee.
BY BOOKING A PHOTOGRAPHIC/MODEL SESSION WITH US YOU ARE AGREEING TO ALL THE TERMS & CONDITIONS LISTED ABOVE.
